Terms and Conditions

The TekCourier.com website's terms and conditions govern the use of the TEK Courier platform, which is provided by TEK Courier Inc. to allow users to receive and perform delivery services for other users. By accessing or using the platform, users agree to be bound by the terms and any future updates to them. Users become "Drivers" or "Senders" upon accessing the platform. Access to the platform is only available through authorized means, and TEK Courier reserves the right to terminate a user's access if they use an unauthorized or incompatible device or app version. The terms may be modified at any time, and it is the user's responsibility to check for updates. Continuing to use the platform after any updates indicates acceptance of the updated terms.

TEK Courier is not Responsible for User Actions :

  • TEK Courier's platform connects Users to contract for goods, but the company is not liable for any actions, inactions, or performance of Users in public, private, or offline interactions. TEK Courier relies on Users to adhere to community rules to maintain a safe, friendly, and helpful environment for everyone.

Users agree to abide by the following rules every time they access the Platform or perform Delivery Services:

  • Users must have the legal authority, right, and capacity to enter into the agreements in these Terms and fulfill their obligations.
  • The Platform is for personal use only and cannot be resold to a third party.
  • Drivers must be at least 18 years old, and anyone younger cannot use the Platform or perform Delivery Services.
  • Only one User account can be created.
  • User account passwords and identifications must be kept secure and confidential.
  • Users must provide proof of identity as reasonably requested and not impersonate or misrepresent themselves or their affiliation with TEK Courier.
  • Users must not collect or store information about other Users, contact them outside the Platform, or disclose any confidential, proprietary, or personally identifiable information.
  • Users must not infringe on the rights of any third party, including intellectual property, privacy, publicity, or contractual rights.
  • Users must not discriminate against anyone based on age, color, disability, gender identity, marital status, national origin, race, religion, sex, or sexual orientation.
  • Users must not assist any third-party in violating the above policies.
  • All contact between Users should end when the Goods ares delivered, and any subsequent attempts to contact another User are prohibited.

TEK Courier enforces its non-discrimination and respect policies strictly. Any User found to violate these policies will lose all access to the platform immediately.

TEK Courier's Non-Discrimination Policy

  • TEK Courier and its affiliates prohibit discrimination against any User or third party based on characteristics such as race, religion, national origin, disability, sexual orientation, sex, marital status, gender identity, age, or any other characteristic protected under applicable law. The company aims to create a safe and welcoming environment for all Users and does not tolerate any discriminatory conduct.
  • Discrimination can take various forms, including intentionally refusing or canceling delivery of Goods to avoid particular neighborhoods due to the characteristics of the people or businesses located in the area. Discrimination can also include being uncomfortable with certain persons based on traits such as age, color, disability, gender identity, marital status, national origin, race, religion, sex, or sexual orientation.
  • TEK Courier encourages all Users to report any discriminatory behavior to the company immediately. The company will investigate any reported incidents and take appropriate action, including terminating Users who violate the non-discrimination policy. TEK Courier is committed to creating a platform that is free from discrimination and welcomes Users from all backgrounds.

TEK Courier strictly prohibits all Users from displaying any aggressive, confrontational, intimidating, threatening, or harassing behavior toward others. This includes, but is not limited to:

  • Physical violence or threatening behavior toward any person or animal. Using language or making gestures that could be disrespectful, harassing, or threatening. Sexual assault or harassment of any kind. This includes unconsented to advances, behaviors, and remarks such as nudging, whistling, winking, or flirting, discussing your own or someone else's sex life, using explicit language, or making jokes about sex. Disrespecting personal space and privacy, such as standing unnecessarily close, commenting on personal appearance, perceived gender identity, or sexual orientation, or asking unrelated personal questions.
  • TEK Courier considers any violation of its Respect Others Policy to be a serious offense and will investigate and take appropriate action, including terminating Users who violate this policy. The company encourages all Users to report any disrespectful or harassing behavior to the company immediately. TEK Courier is committed to creating a safe and respectful environment for all Users.

Drivers to undergo a background check and verification process

  • TEK Courier requires its drivers to undergo a background check and verification process conducted by an independent third-party provider before they are allowed to perform delivery services on the platform. The verification process includes an enhanced criminal background check, electronic identity verification, and driver's license verification. During the registration and verification process, drivers are required to provide a valid driver's license and any other necessary documents to complete the verification and background check.
  • TEK Courier is not responsible for the accuracy or reliability of the driver's identity, completeness of the information provided, or the results of the background check. The company is not liable for any action taken or omission made by it or any third party in response to the information provided by the background check and verification provider.
  • It is the responsibility of the senders to always check the driver's identification and match it to the information in the app before handing over their goods.

Driver Insurances and responsibilities:

  • TEK Courier does not provide or pay for any permits, license or insurance needed by the Drivers to perform Delivery Services on the Platform. Drivers should check with professionals to ensure that they have the required insurance, licenses and permits before they offer to deliver Goods. It is the responsibility of the Drivers to have valid auto insurance in required amounts and to carry proof of all required auto insurance coverage at all times while performing deliveries on the Platform. TEK Courier does not provide automobile liability, workers' compensation or health insurance coverage to Drivers, and is not responsible for paying any liability arising from a Driver's performance of delivery of Goods. Drivers must have the necessary insurance, licenses and permits to carry all Goods and items contained within Goods before offering delivery on the Platform. TEK Courier has no responsibility or liability for any Driver or Sender not having the proper authority, permits, licenses, or insurance to enter into transactions agreed upon on the Platform.

Responsibility to protect the confidential information:

  • TEK Courier and Drivers have a responsibility to protect the confidential information of third parties, including TEK Courier, Senders, and recipients of goods. This confidential information includes Personally Identifiable Information (PII), Protected Health Information (PHI), and any other information to which Drivers have access during the course of delivering goods. PII is any information that can be used to identify an individual, while PHI refers to medical information that is protected by law. Both TEK Courier and Drivers have strict obligations to protect PII and PHI from unauthorized use or disclosure. Drivers are responsible for knowing these obligations and complying with them. Failure to do so may result in the permanent removal of the Driver from the Platform and legal action being taken against them.
  • If a Driver is delivering goods that contain prescriptions, medicines, or other medical documents, they may have access to Protected Health Information. Drivers are required to comply with all applicable provincial, state, federal, and local laws relating to the protection of this information. TEK Courier and Drivers must not use or disclose any confidential information except as necessary to perform and deliver goods.
  • It's important for all Drivers to recognize that they may gain knowledge of third parties' confidential, proprietary, personally identifiable, and/or protected health information through their use of the TEK Courier platform. As a result, Drivers have a strict duty to maintain the absolute confidentiality of all such information and may not disclose it to any other person or use it for any purpose other than to receive or perform delivery services via the TEK Courier platform.

Prohibited items

  • TEK Courier prohibits the delivery of certain items that are considered prohibited items, including people, illegal items, hazardous waste, precious stones, and hazardous materials. Additionally, certain items require prior written consent from TEK Courier and include cigarettes or tobacco products, firearms, ammunition, fireworks, replica or inert explosives or weapons, prescription drugs and medicines, and oversize or overweight items. Drivers must be 19 years old and possess special qualifications, permits, licenses, and/or insurance before offering on delivering any Good containing such items. Drivers must also know and comply with all rules and requirements to carry goods containing any special items before offering such goods, including rules and requirements imposed by Canadian and United States applicable laws. In the event a driver discovers a prohibited item in a good, they are required to notify TEK Courier immediately for further direction.

Goods containing cigarettes, tobacco products, wine, beer, or other alcoholic beverages

  • TEK Courier's terms and conditions state that a Driver must be at least 19 years old to deliver Goods containing cigarettes, tobacco products, wine, beer, or other alcoholic beverages. The Driver must also verify that the recipient of the Goods is not visibly intoxicated before delivering the items. In addition, the Driver must request a valid, government-issued identification demonstrating that the recipient of the Goods is 19 years of age or older. A Driver can be held personally liable for delivering alcoholic beverages to anyone who is visibly intoxicated, and before offering on a delivery of Goods containing any alcoholic beverage, a Driver must be familiar with the signs of visible intoxication.
  • If a driver is unable to deliver a good containing cigarettes, tobacco products, wine, beer, or other alcoholic beverages because the recipient fails to provide valid government-issued identification that demonstrates they are at least 19 years of age or because the recipient appears to be visibly intoxicated, the driver must promptly notify TEK Courier at support@tekcourier.com for further instructions.

Hazardous Materials (HAZMAT)

  • TEK Courier does not allow the shipment of Hazardous Materials (HAZMAT) under any circumstances. All Users are responsible for knowing the complete listings or tables of HAZMATs and complying with all applicable legal requirements before posting or offering any Goods containing HAZMAT for delivery. Senders must ensure that all HAZMAT is properly packaged, labeled, marked, identified, and certified in compliance with applicable legal requirements, including proper shipping papers with emergency response information and an emergency contact telephone number.
  • It is the duty and obligation of every Driver and Sender to know and comply with all applicable Canadian and U.S. provincial, state, and federal laws relating to the pickup and delivery locations of any Goods and all items contained within Goods, whether a Special Item or not, including age restrictions, restrictions on the amounts of certain items that can be shipped, and laws governing the transportation of items over provincial, state, and/or international lines, and between provinces, states, and countries.
  • TEK Courier has no liability or responsibility if a Driver or Sender fails to comply with these Terms or all applicable laws with respect to the inclusion or acceptance of any items contained in a Good or during the performance of the delivery of a Good. TEK Courier is not responsible for the contents or loss of any Prohibited Item or any undisclosed Special Item, and reserves the right to dispose of any Prohibited Item in its sole discretion.

Oversized items and Sender Responsibilities:

  • TEK Courier provides a range of vehicles to accommodate any size of goods for delivery. When a sender places a delivery request order through the TEK Courier App, they must input the dimensions and weight of the goods to allow for automatic calculation of the appropriate vehicle size needed. Once the order is paid for, the App matches the goods with the appropriate vehicle size from the driver pool closest to the delivery address. If the goods exceed the minimum size and weight requirements, the platform will prompt the sender to be present to assist in bringing the goods into the building.
  • Drivers must acknowledge and agree that they are solely responsible for the costs of any medical care they may require due to any injury received while performing the delivery of any goods, whether or not such goods contain bulky, heavy, or oversized items. TEK Courier is not liable to any driver for any costs or damages they may suffer if they are hurt or injured while performing the delivery of goods and drivers are not qualified to receive any health care or other compensation from TEK Courier.
  • Senders are responsible for ensuring that the goods they wish to send can be transported by TEK Courier within the available vehicle sizes. They must input the correct dimensions and weight of the goods in the delivery request order and must be present if the goods exceed the minimum size and weight requirements.

Packing responsibilities of Sender:

  • As a Sender, you have the responsibility to package your items appropriately based on their level of risk, fragility, and other specific factors. It is important to use your common sense when packing your Good. Pickups cannot know what packaging is necessary for any item you send.
  • When sending a Good, Pickups encourages you to use minimal packaging to help the environment and make it easier for Drivers to inspect the contents before leaving with the Good. If packaging is required or desired, Pickups supports and strongly encourages the use of an Open Box Policy. This means that you should always leave packaging open so that the Driver can inspect the contents before leaving with the Good.
  • If you do not leave the packaging open, a Driver has the right to require you to open the packaging to inspect the items before leaving with the Good. If your Good contains new in-box items that are pre-packaged and not open for a Driver to inspect, the Driver has the responsibility to inspect the outside of the packaging. If there is any damage to the outside of the packaging, the Driver should note any damage and wait for instructions from Pickups on following steps regarding damaged Goods.
  • If all or part of your Good contains Baggage, the Driver shall have no right to request or inspect the contents. However, the Driver still has the responsibility to inspect the outside of the Baggage. If there is damage to the Baggage, the Driver should note any damage and wait for instructions from Pickups on what to do next with the damaged Good.
  • It is also your responsibility to ensure that your item is properly packed to withstand transport, or to ensure the safety and integrity of the item and in compliance with all applicable laws. All packaging for such items should be based on the characteristics of the item, in your sole discretion. Please note that Pickups is not liable for any loss or damage to your Good if it is not properly packed.

Cancellation Policy:

  • TEK Courier has specific rules for cancellations and no-shows that Senders should be aware of. Senders are only allowed to cancel their delivery request before a driver is assigned. Once a driver is assigned, Senders must contact customer support through email or phone to cancel their delivery request. If a Sender cancels their delivery request after a driver has been assigned, they will be charged a cancellation fee of $10.00 in addition to any delivery request charges. In cases where the Sender is a no-show or fails to provide the driver with the goods for delivery, TEK Courier will also charge a cancellation fee. If a driver needs to cancel a delivery, they should do so as soon as possible and only in emergency scenarios. In cases where a driver cancels an order after picking up the goods, they must wait at the point of cancellation for another driver to come and fulfill the delivery request.

Temporary suspension and/or permanent termination of user accounts

  • TEK Courier's billing and payment terms and conditions specify the payment processing and refund policies for both customers and drivers. Customers must provide their credit card details when creating a delivery request through the TEK Courier app, and payment is processed by a third-party payment service provider. TEK Courier is not responsible for the payment service provider agreement and has no liability to users under that agreement. Drivers are paid offline and once a week, on the following Thursday before 6 PM.
  • Drivers must provide their HST number and direct deposit details before engaging in any deliveries. Payment processing services are provided by a third-party payment service provider, and TEK Courier reserves the right to switch or use alternate payment processing vendors as needed. Users agree to authorize TEK Courier to share their financial information, credit/debit card details, banking details, and transaction information with the payment processing service provider.
  • TEK Courier is not responsible for any misuse of financial information by the payment processing service provider or any third party. Requests for refunds or credits can be made by emailing support@tekcourier.com, but refunds or credits will be evaluated on a case-by-case basis, and TEK Courier has no obligation to provide refunds or credits to users.

Customers and Drivers billing/Payment:

  • TEK Courier's terms and conditions outline the actions that could lead to the temporary suspension and/or permanent termination of user accounts. These include breaching the terms, failure to verify or authenticate information, causing financial loss or legal liability, fraudulent or harmful activity, regulatory issues, and discovery of prohibited items in goods. TEK Courier may suspend a user's account while investigating incidents and may consider extenuating circumstances when making decisions. Other actions that may lead to suspension or termination include cancellations and no-shows, negative ratings, Third-Party Protection Plan claims, loss of items in goods, and inactive accounts. TEK Courier reserves the right to withhold payments, limit or terminate user accounts, and prevent access to its platform and services if users act inconsistently with its terms and policies or create risks and legal liabilities.

Disclaimer of warranties and limits of liability

  • TEK Courier's terms and conditions for disclaimer of warranties and limits of liability specify that neither TEK Courier, nor its affiliates or licensors, are responsible for the conduct of any user on their platform. TEK Courier and its officers, directors, shareholders, employees, agents, representatives, affiliates and licensors will not be liable for any loss, claim, injury or damage arising in connection with a user's use of the platform or their receiving or providing delivery services. By using the platform, users release and discharge TEK Courier, its officers, directors, shareholders, employees, agents, representatives, affiliates and licensors from any liability related to the use of the platform or their receiving or providing delivery services or the conduct or misconduct of a user.
  • The delivery services, platform, and app are provided to users on an "as is" basis without warranties of any kind, either express or implied. TEK Courier disclaims all warranties to the maximum extent permitted by applicable law. TEK Courier does not warrant, endorse, guarantee or assume responsibility for any service advertised or offered by a third party through the platform or app or any hyperlinked website.
  • TEK Courier does not guarantee that access to the delivery services, platform or app will be uninterrupted, error-free, secure, timely, or operate on any device or in combination with any other hardware, application, system or data. TEK Courier also does not guarantee the results that may be obtained from the use of the delivery services, platform or app, or the quality of any products, services, information, or other material purchased or obtained through the platform or app. Additionally, TEK Courier is not responsible for the completeness or content of any goods or the timeliness, accuracy, or reliability of any user, delivery services, platform or app, or any information or materials provided through or in connection with the use of the delivery services, platform or app. TEK Courier is also not responsible for any viruses, worms, Trojan horses, or other harmful components or any errors or defects in the delivery services, platform or app, or any personal information supplied by users that may be misappropriated, intercepted, deleted, destroyed, or used by others.

limitations of liability

  • TEK Courier emphasizes that it is not responsible for any liability that may arise between users of its platform. Users acknowledge and agree that they use the platform and delivery services at their own risk, and that TEK Courier is only willing to provide the platform if users agree to certain limitations of liability for TEK Courier and third parties. TEK Courier currently has no obligation to assess the suitability, legality, or ability of any user to complete a delivery of goods, and users waive and release TEK Courier from any liability, claims, or damages arising from a user’s delivery of goods. Users also acknowledge that delivery service providers requested through the TEK Courier platform may not be professionally licensed or insured. TEK Courier will not be a party to disputes between users or third-party providers of products or services. Users agree to waive, release, and discharge TEK Courier from any liability, claims, causes of action, or damages arising from their use of the platform or delivery services or related to other users or third parties introduced to them by the platform. Users also agree not to hold TEK Courier, its affiliates, licensors, or partners liable for any damage, suits, claims, and controversies relating to their use of the platform or delivery services, including any arising from the conduct or omission of any user, dispute with any user, or any destruction of their information. Under no circumstances shall TEK Courier, its affiliates, licensors, or agents be liable to any user or third party for any indirect, incidental, consequential, punitive, special, or exemplary damages arising from their use of the platform or delivery services, even if previously advised of the possibility of such damages. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the limitations may not apply to all users.

Intellectual Property:

  • The terms and conditions of the TEK Courier platform state that the company owns all intellectual property rights related to the app, including database rights, copyright, design rights, and trademarks. By using the platform, users agree that they have no rights in the intellectual property.
  • TEK Courier grants users a limited, non-transferable, non-exclusive, revocable license to use the platform via the app on their authorized device, provided they comply with the terms and conditions. However, TEK Courier reserves the right to stop offering the platform or any part of it at any time, at which point the license to use the platform will be terminated, and no refunds or compensation will be provided.
  • Users are not allowed to sublicense, modify, create derivative works based on, or distribute the platform or the app. They are also not allowed to access the platform or app to copy any features or functions of it, launch an automated program that disrupts the platform, or send spam or unlawful material.
  • Users are granted a limited license to view, download, and print content that TEK Courier makes available through the platform or app, but not to copy, distribute, or exploit it for commercial purposes. Any user content posted on the platform or app is subject to a license granted to TEK Courier, which allows the company to use, view, copy, and distribute the content without compensation to the user. TEK Courier respects copyright law and the intellectual property of others and expects its users to do the same. The company may terminate accounts of users who repeatedly infringe copyright holders' rights. Users may correspond with third-party providers, purchase goods and services from them, or participate in promotions on the platform. These activities and any associated terms and conditions are solely between the user and the third-party provider. TEK Courier has no liability for any transactions or agreements between users and third-party providers.
  • Users are automatically opted in to receive SMS messaging when signing up for the platform, and they must agree to receive SMS messages to use the platform. TEK Courier reserves the right to cancel SMS messaging services at any time.
  • TEK Courier's app provides push notifications to users when installed on a mobile device, which are messages that can be received even when the app is not in use. By installing the app, the user agrees to receive push notifications. However, the user has the option to turn off notifications by visiting the mobile device's "settings" page.
  • Users must comply with all export laws and regulations related to the platform and any technical data related to it to ensure that they are not exported in violation of any laws.

Driver Agreement

1. Driver Hiring Processes

As part of our driver hiring processes, we require the following:

  • A reliable insured vehicle
  • Valid Driver's License - Full 'G' or above (no G1 or G2)
  • Smart Phone with a data plan
  • Fluent in English
  • Clean criminal record and clean drivers abstract

We conduct one over the phone interview and one in-person interview, along with two professional reference checks. Additionally, we run a background check, including a driver's abstract and criminal record check, as part of the application process.

2. Driver Training Program

As part of our driver hiring processes, we require the following:

  • a Our dispatchers provide training with our mobile app and routings. Our operation manager provides training with operational processes, policies, guidelines, and procedures.
  • An example of a process is: "If a shipper or receiver is not available, ALWAYS call dispatchers and follow their instructions. If the receiver is not available, NEVER leave the package outside the door without the receiver's consent or dispatcher's instructions."
  • Upon training completion, drivers should be able to complete all types of test order scenarios (Shipper not available, Receiver not available, Return to shipper, Second Attempt, Contact Delivery, Drop at Door/Mailbox, etc.).
  • The following is a Sample of our code of conduct for drivers:

2.1 Drivers Code of Conduct:

  • As a courier driver at TEK Courier, you are representing TEK Courier's QUALITY SERVICE AND PROFESSIONALISM.
  • The Company does not tolerate any consumption of drugs or alcohol by drivers while working for TEK Courier. No alcohol or drugs are permitted in a courier's vehicles. If TEK Courier's Customers believe a driver may be under the influence of drugs or alcohol, TEK Courier has the right to terminate employment immediately.
  • Drivers shall always be properly and decently dressed. No slippers, singlets, and/or shorts are allowed while at work.
  • Drivers shall always exhibit good mannerism as well as communicate with TEK Courier's customers politely. Never use any derogatory, coarse, or vulgar language with TEK Courier customers.
  • Drivers shall never discriminate or harass anyone on the basis of race, national origin, religion, gender, gender identity, physical or mental disability, medical condition, marital status, age, or sexual orientation.
  • Drivers are prohibited from driving without any valid license, insurance. You shall abide strictly by all the 'rules of the road' that are currently considered applicable in Ontario.

2.2 Driver Licensing

  • Drivers shall have a valid license and be appropriately licensed by the Ministry of Transportation for each type of vehicle being proposed in submission for the use of courier services as described herein. It is essential for drivers to possess the necessary insurance coverage, licenses, and permits to transport all types of goods, including those not explicitly categorized as special items. Before committing to a delivery, drivers are advised to consult with professionals to confirm that they have obtained the appropriate documentation. TEK Courier does not assume any responsibility or liability for drivers or senders who fail to secure the proper authorization, permits, licenses, or insurance for transactions conducted on the platform.

2.3 Driver Responsibilities

  • Drivers will not smoke, eat, drink, use cell phone, or use foul language while loading, unloading goods in their vehicles. If a vehicle must be left unattended, the engine is to be turned off and the ignition key removed by the driver. Other appropriate precautions must be taken to ensure that the vehicle cannot be set in motion

2.4 Driver Characteristics

  • Drivers shall be of good character, clean, appropriately dressed, and shall be experienced or trained in the pick-up and delivery of goods as described herein.

2.5 Vehicle Maintenance and Inspection

  • Drivers are required to keep their vehicles in good working condition and ensure that they are safe for use. Drivers should inspect their vehicles before each delivery, and any defects or issues must be reported to TEK Courier immediately. TEK Courier may also conduct periodic inspections of the driver's vehicles to ensure that they meet the required standards.

2.6 Confidentiality and Data Protection

  • Drivers are responsible for maintaining the confidentiality of all information relating to TEK Courier and its customers, including personal information, addresses, and any other information that may be obtained while performing delivery services. Drivers must comply with all applicable data protection laws and regulations.

2.7 Termination of Services

  • TEK Courier reserves the right to terminate the services of any driver at any time without notice, for any reason, or no reason. In addition, drivers may terminate their services at any time by providing TEK Courier with written notice. Upon termination, the driver must return any equipment or property belonging to TEK Courier.

2.8 Modifications to Terms and Conditions

  • TEK Courier reserves the right to modify these terms and conditions at any time, without notice, by posting the updated terms on its website or app. Drivers are responsible for reviewing the terms and conditions periodically and should not use the platform if they do not agree with any changes.

2.9 Governing Law and Jurisdiction

  • These terms and conditions are governed by the laws of Ontario, Canada, and any disputes arising from them will be subject to the exclusive jurisdiction of the courts of Ontario

2.10 Entire Agreement

  • These terms and conditions, along with any additional agreements or policies referenced herein, constitute the entire agreement between the driver and TEK Courier and supersede all prior agreements or understandings, whether written or oral, relating to the subject matter of this agreement.

2.11 Independent Contractor Status

  • As a TEK Courier driver, you agree that you are a third-party user of the Platform and an independent contractor with respect to any and all delivery of Goods performed. You are not and shall not be deemed to be an employee, agent, or representative of TEK Courier or any Sender with respect to any and all delivery of Goods. No Services provided by you via the App nor any action taken pursuant to these Terms shall create an employment relationship between TEK Courier and you or you and any Sender. No driver is entitled to workers’ compensation or any employment rights or benefits from, or sponsored by, TEK Courier or any Sender, including, without limitation, employee, pension, health, or welfare benefit plans, programs, or arrangements of TEK Courier, Senders, or their affiliates or subsidiaries. You will not make any representations regarding your status as a driver providing Delivery Services via the Platform. You shall not have any right to enter into any contract or commitment in the name of, or on behalf of, or to bind TEK Courier or any Sender in any respect whatsoever.

Tek Courier's Sender Agreement, which forms part of our Terms and Conditions. By using our Platform and requesting Delivery Services, you acknowledge and agree to the following terms:

  • You must be at least 18 years of age and have the right and authority to lawfully use our Services or contract for the delivery of Goods. You will list, photograph and disclose all items in the Goods and will not include any Prohibited Items, as listed in the Terms, whether consented to by a Driver or not. You agree that we are not responsible for the contents or loss of any Prohibited Item. We reserve the right to dispose of the Goods, including delivery to the proper authorities, at our sole discretion.
  • You acknowledge and agree to our Open Box Policy and allow our Driver to visually inspect all items within the Goods prior to departure. Unless you have a separate special written agreement with us, you will not include any Special Item as defined in the Terms. You agree that we are not responsible for the contents or loss of any such Special Item
  • You are responsible for properly packing all items within the Goods, including Live Animals, in compliance with all applicable laws. Our Third-Party Protection Plan does not cover reimbursement for any loss or damage to any Goods resulting from (1) any breach of this Sender Agreement and/or the Terms; (2) sending any items on the “Prohibited Items” list; or (3) inadequate packaging. Our maximum liability under our Protection Plan is $100.00 per occurrence, unless Additional Protection is purchased.
  • You will not discriminate or harass anyone on the basis of race, national origin, religion, gender, gender identity, physical or mental disability, medical condition, marital status, age, or sexual orientation. You have the option to select whether you want the item to be dropped off at the doorstep or want to be home to receive the goods. If you select the drop off option and leave the product at the door, we are not responsible if the product goes missing or is stolen.
  • Wait time charges apply after 10 minutes of a Driver waiting at the drop off location. A fee of $.50/minute will be charged. The wait time charges are charged after the order is completed and will show as a separate charge on your credit card in addition to the delivery request charge. If your card has insufficient funds, the system will automatically keep trying to bill the card for a maximum of three (3) times.
  • When requesting a Good to be picked up from a retailer and delivered to your specified location, it is your responsibility to ensure that the retailer offers in-store and/or Curbside Pickup. It is also your responsibility to ensure that the Goods available for TEK Courier pickup are ready and available for pickup at the retailer's location.
  • We reserve the right to refuse or cancel any order for any reason at any time, including if the order violates any of the Terms, Sender Agreement, or applicable law. In such cases, we will refund any fees paid for the cancelled order.
  • We may use third-party service providers to facilitate the delivery of Goods, and that such providers may have access to your personal information solely for the purpose of performing the services contracted for by TEK Courier.
  • You agree to indemnify and hold harmless TEK Courier, its affiliates.
  • TEK Courier reserves the right to refuse or cancel any order for any reason at any time, including if the order violates any of the Terms, Sender Agreement or applicable law. In such cases, TEK Courier will refund the Sender any fees paid for the cancelled order.
  • Sender further acknowledges and agrees that TEK Courier may use third-party service providers to facilitate the delivery of Goods, and that such providers may have access to the Sender's personal information solely for the purpose of performing the services contracted for by TEK Courier. TEK Courier will use commercially reasonable efforts to ensure that any such third-party service providers are reputable and capable of delivering Goods in a safe and timely manner.
  • Sender agrees to indemnify and hold harmless TEK Courier, its affiliates, directors, officers, employees, agents, and assigns from and against any and all claims, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or in connection with any breach of this Sender Agreement, any violation of the Terms, or any other use of the Platform or Delivery Services.
  • TEK Courier may modify this Sender Agreement at any time by posting the updated terms on its website or app. Senders are responsible for reviewing the terms periodically and should not use the platform if they do not agree with any changes.
  • This Sender Agreement is governed by the laws of Ontario, Canada, and any disputes arising from it will be subject to the exclusive jurisdiction of the courts of Ontario.
  • This Sender Agreement, along with any additional agreements or policies referenced herein, constitutes the entire agreement between the Sender and TEK Courier and supersedes all prior agreements or understandings, whether written or oral, relating to the subject matter of this agreement.
